Phone: 01353 668877 Email: 3-kids-online@btconnect.com VAT Registration Number GB 848943375 Interpretation In these Conditions, which are subject to any special terms agreed in writing between us: "Contract" means the contract for purchase of Goods formed by your Order and our acceptance of it on these Conditions; "Goods" means the goods (including any part of them and any accompanying materials) which we agree to supply; "Order" means your order (if accepted by us) or our written quotation to you; "Price" means the price of the Goods at the date of despatch.
These Conditions supersede any previous conditions and may not be varied without our written agreement. All documentation issued by us shall be deemed to incorporate these Conditions. We may correct any error or omission in any such documentation without any liability. Orders & Specifications You acknowledge that all Orders (however placed) which we receive from you shall be subject to these Conditions. You shall ensure the fullness and accuracy of any Order. If we do not consent in writing to the cancellation of an Order you shall indemnify us against all loss (including loss of profit), costs, damages, charges and expenses incurred by us as a result of its cancellation. We shall not be responsible for duplication of an Order: you must state clearly if any communication to us is merely a confirmation of a previous Order rather than being a new Order.
We will notify you if the Goods are not available and, unless you cancel the Order, will hold it until equivalent goods become available. We may make any changes to the Goods needed to conform with any applicable statutory or regulatory requirements (whether national or EC) or which do not materially affect their quality or performance. Price & Payment Prices are correct at the time of listing on our web site but may be changed at any time. However, you will be notified of relevant price changes when you contact us to place an order.
In addition to the Price you shall pay:
- Shipping charges as detailed from time to time on the checkout pages of our website. International customers or customers outside mainland UK should contact us for relevant pricing before placing their order.
- Urgent Delivery Surcharge where the customer requires expedited delivery or delivery outside normal delivery times. Customers should contact us to obtain the relevant cost before placing their order.
- Any applicable VAT (included in all product prices featured on the web site in those cases where VAT applies), import duties and the costs of transport, packaging and insurance. In cases where sales are made to residents of the Channel Islands, the transaction may be completed ex VAT where requested by the customer. In such cases an administration charge of £10 will apply.
You must pay the Price before we deliver the Goods. We will only issue receipts for payment on request (copy invoices and credit notes are available at a cost of £1.00 each).
Time of payment shall be of the essence and we may charge interest (both before and after judgment) on such amounts at 1% per week with a minimum charge of £1. We may charge an administration fee if we need to take legal action to recover any sums due to us from you. Delivery, Risk & Customer Returns Orders received and paid for by 14.00hrs on a normal working day will usually be despatched the same working day or the next working day for orders placed after this time but time will not be of the essence unless agreed in writing. Delivery in instalments shall constitute separate contracts: you may not treat the Contract as a whole as repudiated if we fail to deliver any particular instalment. Delivery will be by first class post, parcel post or guaranteed next working day courier. The choice of delivery method shall be at our absolute discretion unless agreed otherwise in writing. Where a next working day courier is used, delivery shall be between the hours of 07:00 and 19:30 Monday to Friday excluding public holidays. Goods must be signed for and the carrier will only make two attempts at delivering the item. Any additional attempts at delivery must be by prior arrangement and will incur additional costs. If the consignment remains undelivered after 3 working days the carrier will return the consignment to 3 Kids Worldwide Ltd . The carrier will levy additional charges for this which must be met by the customer. These additional costs must be paid before any further delivery is attempted or, if the order is subsequently cancelled, the additional costs will be deducted from the amount of any refund. Unless otherwise agreed in writing and any additional charges paid, Next Working Day delivery applies only to mainland UK addresses. Where a customer outside mainland UK selects Next Working Day delivery we will deliver by other means wherever possible. Where the cost of delivery exceeds the amount paid, we will contact the customer with the option of paying the additional shipping cost or cancelling the order.
No Fault' Returns. Consumer Protection (Distance Selling) Regulations only allow consumers 7 working days to cancel an order or return goods no longer required or mistakenly ordered. Customers may return goods (for any reason) for a full refund of the purchase price up to 7 working days after receipt of the order. 3 Kids Worldwide Ltd will only accept goods back that are complete, unused and in "as new" condition (i.e., if a customer has opened a box to examine a product they must have done so without damaging or marking the product in any way). Goods must be returned in the original box, complete with packing and accessories at the customer's expense. Any 'free' accessories/gifts received with the product must also be returned.Refund will only be for the purchase price only not for any postage costs incurred.
If a product has been purchased as a gift, regrettably we can only refund the credit card of the person who made the purchase.
Customers wishing to return goods for a refund must contact us by email before sending the item(s) to us at their expense. We strongly recommend obtaining proof of shipment and, for valuable items, using a form of delivery that requires a signature.
Returned Goods will be accepted only if they are accompanied by an authorisation number (which you must obtain by either telephoning or emailing us and providing the Goods' date of purchase and invoice number). 3 Kids Worldwide td will not accept responsibility for Goods, which, in its opinion, have been subject of undue wear and tear, accident, misuse, improper application or neglect. Risk in returned Goods shall not pass until they are received in our premises and you shall be responsible for providing evidence of receipt if requested by us to do so and for all transport and other costs. After the initial first 7 days, an exchange is available for faulty goods under guarantee, at a cost of £16.99. This cost covers courier charges.
Risk of damage to or loss of the Goods shall pass to you when we despatch them but property in them shall not pass until you pay the Price in full. Until property passes you shall hold the Goods as our fiduciary agent and bailee and we may at any time require you to return them and, if you fail to do so forthwith, enter any premises and repossess them. General Any notice under these Conditions shall be in writing addressed to the other party at its registered office or such other address as may be so notified to the party giving the notice. If delivered by hand it shall be deemed received on the day of delivery or sent by registered post or recorded delivery 3 business days after posting exclusive of the day of posting, or if sent by facsimile transmission or similar means of communication at the time of transmission.
No waiver by us of any breach by you shall be considered as a waiver of any subsequent breach of the same or any other provision.
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the remainder of the Contract shall not be affected.
We may from time to time send you promotional information on other goods or services we may offer from time to time.
We may assign or sub-contract the performance of our obligations under the Contract or any part thereof or assign the benefit of our rights hereunder at any time but you may not do so without our prior written consent.
The Contract shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts. Liability 3 kids worldwide ltd will warrant that all products stated as being brand new will be free from defects and failure for a period of 12 months from the date of dispatch. Any manufacturer's warranty that differs from the above will take precedence. It is the customer's responsibility to obtain such warranty information at the time of purchase. However, all descriptions of the Goods not expressly warranted by us are indicative only (they are not part of the Contract) and, in the case of Goods not manufactured by us, are subject to any current description and guarantee (if any) made available by their manufacturer. We shall not be liable if the Goods are not suitable for your purposes, nor for any representations whatsoever which are not confirmed in writing.
We shall not be liable:
- if you do not pay the Price in full when it becomes due
-for any defect in the Goods arising from any information supplied by you or from fair wear and tear, abnormal use, neglect, alteration or repair of the Goods without our prior approval
- for matters beyond our reasonable control
- for any matter directly or indirectly related to any failure of any Goods to: (a) recognise any date as its true calendar date, to function properly as a result of treating any date other than as its true calendar date or to correctly process, save or otherwise deal with any data in consequence of any date (b) perform using the Euro or any other currency adopted by full member states of the EU as required by EC Regulation 1103/97 and to convert to other currencies and process multiple currencies.
Customers must notify 3 kids worldwide ltd of a damaged parcel/product or short delivery within 3 working days of receipt. A claim reference will be given and once a full investigation is carried out a replacement/credit may be issued. Customers may be contacted by the courier in the event of a damaged product/parcel. Time is deemed to be of the essence and any claims received after this period will not be processed.
Any non-stocked products that are ordered specifically for customers may only be returned if authorisation is granted by the supplier of the product to 3 kids worldwide ltd.
All returns must be returned to 3 kids worldwide ltd within 7 days of the return authorisation being granted.
Unless you are dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977, as amended), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law. If this is a consumer transaction your statutory rights are not affected by these Conditions.
Except in respect of death or personal injury caused by our negligence, we shall not be liable for any implied warranty or other term, or any indirect loss or damage (whether loss of profit or otherwise) or other claims for compensation whatsoever which arise out of or in connection with the Goods and our entire liability shall not exceed the Price.
We shall not accept the return of any manual or other thing provided in a clear sealed package if you open the packaging, unless faulty or mis-described.
General descriptions and copy matter are published for the benefit and assistance of customers and do not form the basis of any contract.
3 kids worldwide ltd has taken all possible care to ensure accuracy of information, but will not accept responsibility for damages or injury due to error or omission in respect of any technical information. Insolvency If you:
- make any voluntary arrangement with your creditors or become bankrupt, become subject to an administration order or go into liquidation (otherwise than for the purposes of amalgamation or reconstruction), or an encumbrancer or receiver affects any of your property or assets or
- cease, or threaten to cease, to carry on business or if we notify you that we reasonably believe that any of these events is about to occur, we may cancel the Contract or suspend deliveries under it and the Price shall become immediately due and payable. Privacy Policy 3 kids worldwide ltd do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
